Article 1 — Purpose
These Terms of Sale (« ToS ») govern the contractual relationship between OptoCenter (« the Seller ») and any natural non-commercial person (« the Customer ») making a purchase on optocenter.fr. Any order implies full and unreserved acceptance of these ToS in the version in force on the day of the order.
Article 2 — Products
The products offered are the optical glasses, sunglasses, contact lenses and optical accessories presented on the site, subject to available stock. Photographs and descriptions are provided for guidance only; slight variations (colour, finish) may exist without engaging the Seller's liability.
Article 3 — Prices
Prices are indicated in euros, all taxes included (TTC), excluding delivery charges. Delivery charges are specified before order validation. The Seller reserves the right to amend prices at any time; the applicable price is the one in force on the day of the order.
Article 4 — Order
The order is deemed accepted by the Customer when the validation click is performed at the payment step. An acknowledgement of receipt is sent by e-mail. The sale is only definitively formed after confirmation of payment by the bank provider. The Seller reserves the right to refuse or cancel any order showing abnormal characteristics or in the event of an unresolved prior dispute.
Article 5 — Payment
Payment is made online by bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, PayPal or Alma split payments. Transactions are secured by our provider Stripe (PCI-DSS standard). No bank data is retained by OptoCenter.
Article 6 — Delivery
Products are delivered to the address indicated by the Customer when placing the order. Standard delivery times are [X] to [Y] business days in mainland France. Delivery is free from €[threshold] of purchase. In the event of a delay attributable to the Seller, the Customer may, after formal notice that has remained without effect, terminate the contract in accordance with article L.216-2 of the French Consumer Code.
Click & collect: in-store pickup is free. The Customer is notified by e-mail as soon as the order is made available.
Article 7 — Right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise the right of withdrawal, without having to give a reason or pay a penalty (excluding return costs).
To exercise this right, the Customer may use the form below or any other unambiguous declaration addressed to: contact@optocenter.fr.

Statutory exclusion — prescription-cut lenses: in accordance with article L.221-28 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer's specifications or clearly personalised. This exclusion applies to prescription eyewear whose lenses have been cut, ground or coated according to your prescription (Rx single-vision, Rx progressive, Rx tinted, Rx photochromic). It also applies to opened corrective contact lenses. It does NOT apply to standalone frames delivered without corrective lenses, non-corrective sunglasses, or accessories (cases, sealed care solutions).
Warranties preserved: the withdrawal exclusion does not affect the statutory warranties of conformity and hidden defects — see Article 8.
Article 8 — Statutory warranties
All products benefit from:
— the statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code), for two (2) years from delivery of the goods;
— the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), for two (2) years from discovery of the defect.

Article 9 — Complaints and mediation
Any complaint may be addressed to: contact@optocenter.fr. In the event of persistent disagreement, the Customer may, in accordance with article L.612-1 of the French Consumer Code, use the consumer mediation service free of charge:

Article 10 — Intellectual property
All content on the site (texts, images, logos, code) remains the exclusive property of OptoCenter or its partners. See the legal notice.
Article 11 — Personal data
The processing of personal data is governed by the privacy policy.
Article 12 — Governing law and jurisdiction
These ToS are governed by French law. Any dispute is subject to the competent jurisdiction in accordance with the rules of civil procedure. For consumer Customers, the protective provisions of the French Consumer Code apply.
Article 13 — Identity of the responsible optician (French Public Health Code article R.4362-14)
In accordance with article R.4362-14 of the French Public Health Code, online sales of corrective lenses and corrective contact lenses are carried out under the responsibility of a qualified optician. The name and RPPS number of the optician responsible for the OptoCenter site are stated in the legal notice and in the footer of every order, quote, and invoice.

Article 14 — Health-data hosting (prescriptions)
Prescriptions you send to OptoCenter — photographs or PDF files — constitute health data within the meaning of article 9 of the GDPR. They are hosted on a server approved as Health Data Host (Hébergeur de Données de Santé, HDS) in accordance with article L.1111-8 of the French Public Health Code. The name of our HDS provider is stated in our privacy policy.
Your prescriptions are accessible only to you (from your account) and to authorised OptoCenter opticians strictly for the purpose of validating your order. They are never shared with commercial third parties.
Article 15 — Public and complementary insurance reimbursement
At the date of these ToS, OptoCenter does not yet operate online tiers payant for corrective lenses. You therefore pay the full amount of your order at checkout. After receipt, you retrieve your invoice, your paper care claim slip (Cerfa n° 12541*04 / S3126) and, where applicable, a copy of your prescription from your account. Once these documents are mailed to your local Caisse primaire d'assurance maladie (CPAM), the public share (AMO) and then the complementary share (AMC) are reimbursed to you according to your entitlements.
